Clarification on copyright rules for adding pictures/gifs?

What's the site's stance on using non-royalty free images and gifs?

I'm asking because the rules clearly state one thing, yet I've seen plenty examples on the site doing the opposite; the majority of gifs and pictures belonging to various porn publications and/or companies, or independent artists, with a fair few of the authors not even bothering to edit out the watermark or providing even the bare-bones necessary alterations. Even so, even if adequately altered, like censoring faces or removing watermarks, adding filters and whatnot, I'd wager there's plenty of ways for the people in a specific image to be identified.

Is the case such that until the point in time when the owner of the material actively moves against the infringing activity, like directly filing copyright/takedown notices, everything's 'fair game' and everyone's doing their own little pockets of the wild west until the big man comes down from their mountain?

What would happen in that kind of context? Say, a fairly long story with a couple of pictures gets hit with a notice: does the whole story get deleted and the author's account terminated immediately or would they be given chances to edit out the infringing material to the satisfaction of the notice?

    Thanks for the responses.

What exact part of the Rules are you referring to?

CHYOA's copyright policy can be found on the page Copyright and DMCA Policy.

I've already read that and it's why I'm seeking further clarification, since there's a lot of stories on the site that don't abide by it, but are still up.
I was hoping whoever responded would touch on the core of my question, and read past the first couple of words of the first sentence.

We can't judge if the use of an image falls under fair use or not, or if the user has or has not the right to display an image.
